Court Decides On Ex-Abia Gov Kalu’s Retrial September 20
Orji Uzor Kalu

A federal high court in Abuja has fixed September 20 to deliver judgment on the suit by Orji Kalu, former governor of Abia state, challenging his retrial by the Economic and Financial Crimes Commission (EFCC) on money laundering charges.

Justice Inyang Ekwo adjourned the matter tentatively to September 20 for judgment after the parties have adopted their processes.

Justice Ekwo also stated that parties will receive hearing notice if the date changes.

Kalu’s counsel, Awa Kalu SAN, told the court that his client had already been tried, convicted, and imprisoned.

Relying on Section 36(9) of the Constitution, he argued that it would amount to double jeopardy for Kalu to be tried the second time.

Thus, he prayed the court to stop the Economic and Financial Crimes Commission from going ahead with the trial.

However, prosecuting counsel, Rotimi Jacob accused the applicant of trying to take advantage of the verdict by the supreme court and avoid the burden that comes with it.

He said the application by Kalu is a strange one as it is filing a case to terminate a case.
