Walter OnNoghen loses at the supreme court again

An application by the Cross River State Government challenging the suspension of Justice Walter Onnoghen as the Chief Justice of Nigeria has been struck out by the Supreme court.

This decision was made on Friday after the court stated it lacked jurisdiction to entertain the matter and consequently dismissed the application.

Recall in January, Justice Walter Onnoghen was suspended by an order of the Code of Conduct Tribunal. Not long after he was suspended the Cross Trivers state government sought the Supreme Court to ask that it invoked section 232 (1) of the constitution to assume original jurisdiction on the matter.

The state government cited violations of the constitutional provisions in the suspension.

The Supreme Court did agree with the FG that it lacked jurisdiction to handle the suit. However, in her judgement, Justice Mary Odili held that the suspension failed to follow the procedure as stipulated by law, adding that the Supreme court does have jurisdiction to handle the case.
